The Constitution does NOT identify the responsibility of judicial review at all and does not call out the function of Federal judges, only allowing their existence per acts of Congress. Judicial Review was started with Marburg vs. Madison and is not supposed to be political as it has evolved into. The only thing judicial review is supposed to do is test the Constitutionality of laws passed by Congress and approved by the president. It has been turned into a political monster, being used almost exclusively by the Left to attempt to make law and modify what Rightist presidents want to do. EOs are a target with Trump and were not so much with Biden. If EOs can be a target, why aren’t by-laws and regulations set up by unelected bureaucrats under judicial review. This is probably the number one success story of the Democrats over the last 70 years.
